Construction VAT: 6% or 23%, and who accounts for it?
Duas perguntas diferentes, e quase toda a gente as baralha. Two different questions, and almost everyone mixes them up. One is which rate applies, that depends on the work and the property. The other is who accounts for the tax, that depends on whether you hold an alvará and on your client's VAT status. Answer a handful of questions and we tell you exactly what to write on the invoice.

Also invoice services (consulting, design, software) to foreign clients? The services VAT checker covers reverse charge, out-of-scope and the OSS threshold. And the freelancer calculator shows what's left of what you invoice in foreign currency.
Until 30 June 2026, reverse charge applied to any construction service supplied to a business with the right to deduct, whether or not you held an alvará. The Ofício-Circulado n.º 25117/2026 revoked that 2007 doctrine. Since 1 July, reverse charge applies only if the supplier holds an alvará or certificado de empreiteiro issued under Lei n.º 41/2015.
In practice: a painter without a certificate invoicing a business now charges VAT on the invoice, where they used to write "IVA - autoliquidação". It's the opposite answer, and most of what's written online still dates from before.
Perguntas frequentes Frequently asked questions
Quando é que a obra tem IVA a 6%? When does a job carry VAT at 6%?
The commonest route is rate 2.27 of List I annexed to the CIVA: works of improvement, remodelling, renovation, restoration, repair or maintenance of properties used for housing. The property must be in use as housing before the work and remain so afterwards. New construction, extensions and reconstructions fall outside this rate, as do cleaning, green-space maintenance, pools, saunas and tennis courts. But 2.27 is not the only door to 6%: rate 2.23 covers rehabilitation of buildings in an urban rehabilitation area (and, unlike 2.27, is not limited to housing) and rate 2.42, since 2026, covers construction and rehabilitation for sale or residential letting. The check walks all three in the right order.
E os materiais? And the materials?
The reduced rate covers the labour. Incorporated materials go at the normal rate, unless their value doesn't exceed 20% of the total supply, in which case the whole invoice is at the reduced rate. Note it's not exceed: exactly 20% still qualifies.
Preciso de alvará para haver autoliquidação? Do I need an alvará for reverse charge to apply?
Since 1 July 2026, yes. Ofício-Circulado n.º 25117/2026 limited reverse charge to suppliers holding an alvará or certificado de empreiteiro under Lei n.º 41/2015. Before that date it was the opposite: Ofício-Circulado n.º 30101/2007 said expressly that the alvará did not condition the rule.
Eletricistas, canalizadores e outras especialidades precisam de alvará? Do electricians, plumbers and other trades need an alvará?
These installations are part of the construction activity (Lei n.º 41/2015, Annex I), so the 2026 rule applies just the same: since 1 July 2026, reverse charge only applies if you hold an alvará or certificado de empreiteiro. In housing, repairing or improving the property's installations is repair or improvement for rate 2.27, 6% on labour, and the materials (cabling, panels, pipes) at the normal rate if they exceed 20% of the total.
What if my client is a private individual?
There's no reverse charge. A private individual is not a VAT taxable person, so you charge the tax on the invoice, at whatever rate the nature of the work produces.
O que é a verba 2.42? What is rate 2.42?
It's the new regime created by Decreto-Lei n.º 97/2026: 6% on works of construction or rehabilitation of properties intended for sale as own permanent housing, or for residential rental. It takes effect from 1 July 2026 and ends on 31 December 2032, but it reaches tax that became due from 1 January 2026; in that window the rate is arrived at by correcting the invoice already issued and, where the acquirer has no right to deduct, by a joint election of both parties.
Two things commonly got wrong. First, the acquirer does not always self-assess, the art. 2.º(1)(j) extension reaches acquirers without a right to deduct and public bodies; a private individual buying the home never self-assesses, and there you charge the 6% yourself. Second, the price and rent limits, the dates and the client's written confirmation do not exhaust eligibility. The regime also requires the property to be transacted within the statutory period, the acquisition title to cite the verba expressly, and (on the rental path) the lease to be reported to the AT and the property let for housing for a minimum period. These are facts that postdate the invoice: if they fail, it is your client who regularises the tax. The check gives you the exact periods at the end of its answer.
What if the property is in Madeira or the Azores?
The rates aren't the mainland's: they're set by the regional governments, not by the CIVA. In Madeira, 4%, 12% and 22%; in the Azores, 4%, 9% and 16%. The check applies the table for the region where the property is: pick it in the form.
A obra é num imóvel fora de Portugal The work is on a property outside Portugal
Services connected to immovable property are taxed where the property is (art. 6.º(8) CIVA). Work outside Portugal is outside Portuguese VAT and outside this tool's scope: the rule of the property's country applies.
Isto substitui o meu contabilista? Does this replace my accountant?
No. This is information, not tax advice, and some cases turn on facts a page can't know. When it's one of those, we tell you, instead of inventing an answer. And a note on what you answer here: when you tick that the client confirmed rate 2.42 or that you hold an alvará, that enters the calculation as an assumption of yours, not as a verified fact. A client's declaration is evidence to keep; it is not, on its own, what makes the operation eligible.
